Senate Bill 180, Sher, Signed by Governor Gray Davis on September 25, 2000
SB 180 governs provisions for the reporting of food facility inspection findings and the outdoor display of non-potentially hazardous foods. In addition, the bill allows for outdoor beverage bars contiguous to a permitted food facility. Here are some highlights of SB 180:
- By January 1, 2002, State DHS is to establish standardized reporting procedures and a standardized food facility inspection format for local environmental health agencies for each food facility inspection, reinspection, date of last inspection, any closure, and the facility name and address that includes all of the following:
- The name and address of the food facility.
- Date of last inspection.
- Identification of any major violation identified in a food facility inspection.
- Reinspection date, if applicable.
- Period of closure, if applicable.
- Identification of the following inspection criteria, which is the basis of the inspection report:
- Improper holding temperatures.
- Inadequate cooking.
- Poor personal hygiene of food handlers.
- Contaminated equipment.
- Food from unsafe sources.
- Commencing July 1, 2002, each local health agency that reports food facility information on an Internet web site must provide food facility inspection information in accordance with these reporting procedures.
- A copy of the most recent inspection report must be maintained at the food facility. The food facility must post a notice advising patrons that a copy of the most recent inspection report is available for review by interested parties.
- The bill allows for the outdoor display of prepackaged non-potentially hazardous food and/or uncut produce, contiguous to a fully enclosed food facility.
Outdoor beverage bars are allowed as an unenclosed facility when operated on the same premises as, or in conjunction with, a fully enclosed food establishment; alcoholic and nonalcoholic beverages are allowed to be prepared out of doors.
